1. Acceptance and Changes

1.1 Acceptance

These Terms form an agreement between you and the developer of ShiftNest regarding your use of the App. By downloading or installing the App from an app store, or using it in any other way, you are deemed to have read and agreed to these Terms. If you do not agree to any part of them, please stop using the App and uninstall it immediately.

1.2 Changes

We may revise these Terms from time to time due to changes in laws and regulations, business adjustments, or product improvements. The revised Terms will be published in the app or otherwise notified to you. If you continue to use the App after the revision, you are deemed to have accepted the revised Terms. If you do not agree, please stop using the App.

2. The Service

2.1 Overview

ShiftNest is a smart sleep planning tool built for shift workers, night-shift staff, and rotating-schedule employees. It is designed to help people with irregular schedules sleep better.

2.2 Core features

• Shift-aware sleep advice: based on your shift schedule, the App calculates and recommends your best sleep times, covering main sleep, recovery naps, pre-shift naps, and other sleep types.
• Smart alarms: wake-up alarms, recovery nap alarms, and pre-work reminders, with light-sleep wake-up (a Pro feature).
• Sleep records: manually log sleep data including bedtime, wake time, and sleep quality rating, with support for multiple sleep segments on the same day.
• Analysis: trend charts for sleep duration and quality, plus statistics on how often you hit your sleep goal.
• Apple Health integration: after you grant permission, sleep data from Apple Health is read and shown together with your own records.
• Custom shifts: five built-in shift types (morning, mid, evening, night, rest) plus your own shifts with custom names, colors, and times.
• Personal settings: configure your target sleep duration, wind-down time, morning prep time, regular schedule, and more.

2.3 Pro membership

The App offers a Pro subscription, which unlocks these advanced features:

• Light-sleep wake-up: wakes you at your lightest sleep stage so getting up hurts less
• Wake window: set the time range in which the alarm may wake you
• Advanced sleep analysis: deeper insight into your sleep data
• Algorithm notes: learn the science behind the sleep calculations

Pro pricing, billing periods, and renewal rules follow the in-app purchase screen and the applicable App Store rules. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period; you can turn off auto-renewal at any time in your Apple account settings.

3. Your Responsibilities

When using the App, you agree to the following:

• Comply with applicable laws and regulations, and do not use the App for any unlawful purpose.
• Do not reverse engineer, decompile, or disassemble the App, or attempt to obtain its source code by any other means.
• Do not modify or tamper with any feature or data of the App, or exploit vulnerabilities for improper use.
• Do not interfere with the normal operation of the App, or attack or intrude into any of its systems.
• Do not use the App for commercial purposes, including selling, renting, or transferring the App or the right to use it.
• Do not remove or alter any copyright, trademark, or other proprietary notices in the App.

If you breach any of the above, we may stop providing the Service to you immediately and reserve the right to pursue legal remedies.

4. Intellectual Property

4.1 Our intellectual property

The App and its content (including but not limited to software code, interface design, icons, text, algorithm logic, and data structures) are owned by the developer of ShiftNest and protected by applicable copyright, trademark, and patent laws.

4.2 Your content

You own the intellectual property in the content you create in the App, such as sleep records, custom shifts, and settings. You grant us a free, non-exclusive, revocable license to use that content only as needed to provide and improve the Service.

4.3 Third-party content

The App may include third-party content or links (for example, the HealthKit framework and system icons). The intellectual property in that content belongs to the respective third parties. We are not responsible for the accuracy, completeness, or legality of third-party content.

5. Disclaimer

5.1 Service availability

We make reasonable efforts to keep the App running smoothly, but we do not guarantee that the Service will be uninterrupted or completely error-free. We are not liable for interruptions or data loss caused by system maintenance, network failures, or device compatibility issues.

5.2 Accuracy of sleep advice

Sleep advice is calculated from general sleep-science principles and the schedule data you provide, and may not fully fit every individual. The advice is for reference only — please adjust your routine to what works for you. We are not liable for any health issue arising from your use of the sleep advice.

5.3 Alarms

The alarm feature depends on the iOS notification and alarm frameworks. We are not liable if an alarm does not fire or is delayed due to system limitations, disabled notification permission, silent mode, system updates, or similar causes. For important commitments, we recommend using a second alarm as a backup.

5.4 Apple Health data

Sleep data read through HealthKit comes from the Apple Health app, and its accuracy depends on the source device (Apple Watch, iPhone, and so on). We are not responsible for the accuracy, completeness, or timeliness of HealthKit data.

5.5 Data security

We take reasonable measures to protect your data, but we cannot guarantee absolute security. We are not liable for data leakage or loss caused by force majeure, lost devices, or system vulnerabilities. Please back up important data regularly.

5.6 Third-party services

The App may rely on third-party services such as the Apple App Store, HealthKit, and the notification system. We are not liable if the App cannot work properly because those services change, are interrupted, or are discontinued.

5.7 Medical disclaimer

The sleep advice, alarm reminders, and sleep analysis provided by the App are for reference only and do not constitute medical advice. They cannot replace diagnosis or treatment by a qualified doctor.

The App is not a regulated medical device and is not intended to diagnose, treat, prevent, or cure any disease. All features are general wellness tools designed to help you manage shift schedules and sleep better.

If you have a sleep disorder, health concern, or need medical advice, please consult a qualified medical professional or doctor. The App accepts no medical responsibility for any health issue arising from its use.

6. Termination

6.1 Termination by you

You may terminate these Terms at any time by uninstalling the App. After termination, you must stop using all features of the App.

6.2 Termination by us

We may stop providing the Service to you in these cases:

• You breach any term of these Terms
• Your conduct may cause loss or risk to us or to other users
• We are required to stop the Service by law or policy changes
• We decide to stop developing and operating the App for business reasons

6.3 After termination

After termination, the provisions on intellectual property, disclaimers, and dispute resolution remain in effect. Data stored locally on your device remains there; please export or back it up before uninstalling the App.

7. Dispute Resolution

7.1 Governing law

These Terms are governed by the laws of the People's Republic of China. Notwithstanding the foregoing, mandatory consumer protection laws of your country of residence apply to the extent they cannot be contracted away.

7.2 How disputes are resolved

Any dispute arising from or relating to these Terms should first be resolved through friendly negotiation. If negotiation fails, the dispute shall be submitted to the competent court at the developer's location; provided, however, that this does not limit any mandatory consumer-protection right or forum available to you under the laws of your country of residence.

8. Other Terms

8.1 Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions stay in effect. The invalid or unenforceable provision will be replaced by a valid one that comes closest to its original intent.

8.2 No waiver

Our failure or delay in exercising any right under these Terms does not waive that right. Partial exercise of a right does not prevent further exercise of it or of other rights.

8.3 Notices

We may send you notices through in-app popups, in-app announcements, or email. Please send notices to us using the contact details below.

8.4 Entire agreement

These Terms (together with the Privacy Policy) form the entire agreement between you and us regarding your use of the App, and supersede all prior oral or written understandings.
